This just made me sad

I used to look up to this dude even though I didn’t know much about him but he was one of the only somewhat successful producers from Jersey when I was a kid..

If I’m not mistaken the word around the way in Jersey was that he got jacked for the  O.P.P. beat..

who knows, but he did have a flip of the J5 sample on the above album which came out before O.P.P.

You know I know all about that kind of speculation.

Regardless, the dude was a local legend.

Some of his  beats for YZ were incredible for the time.

    interesting.. being that the song is sample based. they ususally throw those things out because most sampled songs are considered un-copyrightable due to the fact that they are based on pre-exisitng copyrighted material. in a case where the samples were not cleared. if so though, congrats to him on that.

    I had that PRT record he produced on heavy rotation back in the day. Never knew who produced it at the time. That was way before I even started reading liner notes. RIP Tony D. It’s unfortunate.

    BTW - JUST - It’s not that simple. Derivative works (which include songs derived from preexisting, copyrighted music) could get copyright protection for the composer/author but only to the extent of the original material that is contributed by that composer. I’ve never heard the song Tony D produced, but, assuming it is different and original enough compared to the J5 song to get copyright protection, Tony D could own a copyright to his derivative work, but, of course, not a copyright in the sample he used. There is also still an issue of whether the derivative work is authorized (in this case - sample cleared) by the copyright owner of the underlying work or if it was a fair use, etc. But, I’ll spare you the dissertation. I think you get the idea …

    yes randy.. im well aware of sample laws. i have been in court for a very very very similar situation.. but like u, im not going to do a dissertation on it. and im 95% sure that tonys record was not cleared. it was a local NJ release on an indie label in 89.. basically a beat cd on record, which is exactly why i said what i said (read my comment again, i did say someting to the effect of the sample more than likely not being cleared). something like that WOULD get thrown out of court when going against a major label, that probably did at one point or another clear the sample. at that point its just the code of the streets.

    I only commented further because saying that sampled songs are uncopyrightable just because they are based on pre-existing copyrighted material is not an accurate statement. Just because a creative work is based on someone else’s work does not automatically make it uncopyrightable.

    You’re mixing up two different issues. Being authorized to use a sample is only one part of the analysis. The issue of being copyrightable is more an issue about originality as I said in my comment above. Being authorized to use a sample is a separate issue.

    There are instances where sample-based songs do not need authorization from the sampled song’s copyright owner (e.g. fair use and sampled songs that are public domain).

I don’t know about all the logistics behind the case - but I did find a site that has a copy of the Matty C-written article from the Source (http://ifihavent.wordpress.com/2009/04/05/jackin-for-beats-tony-d-in-the-source-1992/). I think Tone’s argument was that Kaygee jacked his loops, well, three of them. Kaygee is saying “Adam’s Nightmare” is wack, and I know that Naughty had that dude Dave play the piano live, and they added live bass. I’m not sure about what grounds Tone had a case, but I’d always heard that they settled out of court, so who knows. Maybe someone needs to find Kaygee and speak on it?

    my whole statement was based on the fact that there was no sample clearance on the tony d record more than likely . and in a situation like that a court will consider the work unable to be copywritten. im not talking about all the possible scenariois. im talking about THAT scenario. Im not talkign about Mozart or random 15th century composition or some public domain work. I m talking about the Jackson 5 .Im not mixing up anything. but i think You’re mixing up the fact that you think I’m trying to apply ONE scenario to EVERYthing. like really, what would i look like saying that any song with a sample is not copyrightable?? that would make half my catalog null and void.

    @ randy i probably could have worded what i said to cover a broader spectrum and be more indepth but i was really talking about one specific type of situation, if you look at what i said, (which i just did to be clear since i wrote that 5 minutes after i woke up and read the news) IMO my statement reflects that. If you don’t feel it does we can agree to disagree, no harm no foul. but i havent gotten this far in my career not knowing how the law works when it comes to sampling and copyright. so i think the arguement is really just one of wording and semantics. believe me I’e had enough crabs accuse me of stealing “ideas” to the point where i have no choice BUT to know about these kinda t hings front to back.

    yes and that was followed by the bit about a sample not being cleared. which was the basis of my entire point.

    i dealt with this a court case that endured over 2 years. someone made a BS claim against me a while back. was the worst experience of my life. and what we’re dscussing right now ended up becoming the key issue in the case. while i didnt exactly learn anything i didnt alread know, i definitely came to understand the technical aspects of the law in regards to copyright with a whole new clarity as far as the specifics..

    B: I did “The Blueprint” which was right after that but I kind of shadow away from the whole Roc-A-Fella scene because I was actually mimicked by somebody within the camp. It doesn’t feel right with me just because I’m from the old school and taking somebody else sound or style or whatever which was called “biting” back in the day is real personal. In the new school, there’s no such thing as “biting”, it’s about getting a check. That’s what I hate about the game. The whole creative side is not here anymore. Back in the day, people used to get shot and beat up over stuff like that.

    B: Of course! You are the type of guy that pays attention to details. The average fan or the average consumer, they don’t really care about who got what from who. That’s not their concern. If the record is hot, it’s all they care about. But if you are a fan of music, and you have really followed the game, then you know what I brought to the game and what people borrowed from me since I came in.

    The crazy thing is that I used to be cool with the guy. Just Blaze and me were cool at one time doing the whole “Dynasty” and “Blueprint”. Once it got to the point where he was taking what I was doing, it doesn’t fit right with me. He ended up signing to Gee Roberson and Hip-Hop who were A&Rs for Roc-A-Fella. Once I wasn’t really feeling what was going on, they kind of let me behind and I pursued my career in other places.

    A: So you ‘re any longer cool with Just Blaze, right?

    B: We definitely don’t talk [laughs]. But when I first met the guy, he sounded like Swizz Beatz! That’s the irony to the story. He’s the only guy that I’ve heard in the game taking from so many producers. He’s starting to come to his own now a little bit but even now he’s more sounding like a Toomp or a Drumma Boy. He does what’s hot and that’s the part of the game that I told you I don’t agree with. I’m not going to do something because everybody else is doing it. He’s infamous for borrowing from people, that’s his M.O.. He’s a talented guy, I might say but he hasn’t brought anything to the game that he has come up with. That’s the only thing he’s missing: his own sound.

    2nd, I don’t get what Bink would get out of saying something like that (bitter? who knows) even if he truly felt that way. He’s not a rapper! Don’t get me wrong, I like some of Bink’s beats and his drum patterns. I just don’t hear the biting he is accusing Just of. I could most def see why Just would take that very seriously. I think this is worse than saying someone bit one beat because he is implying that Just got all of his work @ the Roc because of it.     I was a intern at this entertainment lawyers office that actually worked with the Tony D for that case between Opp and Tony D. It’s funny you brought this up because the first day he shows up to the office I knew of him but actually didn’t know that he was “WHITE” because if you look at the album cover the artwork didn’t depict him that way and i never bought the album to even see the back. Anyway Tony shows up and the lawyer was actually somewhere else and Tony D sits down and for some reason,probably gravity,he falls out the chair.Me being young he expect me to be laughing my ass OFF but i actually didn’t because he was actually about suing a friend i went to school with named Keir Giest . What happen was the story he told AND I was in that office was HE PLAYED the beat some how to Naught By Nature or they heard HIS beat and some how flipped it different. The problem was the publishing at the time neither one of them had cleared the sample and A case like this was actually at the very beginning of sampling laws so the only person who could actually sue was the publishing company that actually owned J5 sample and it was complicated. They actually wanted to hear what he was actually suing for the music theory, which wasn’t his. He actually was trying sue for the hearing of the sample or the authentication of how the song was sampled and that situation was unheard of at the time. So the lawsuit never became any further than that meeting with lawyers because they actually thought Naughty made alot of money off that song Naughty actually didn’t they just sold platinum and that’s was it. Royalties were a entire different situation
